PRAYER: Transfer Civil Miscellaneous Petition filed under Section 24 of the Civil Procedure Code to withdraw H.M.O.P.No.3562 of 2019 from the file of the Principal Judge, Family Court, Chenai and transfer the same to the file of the Subordinate Court, Alandur for proper and early disposal. O R D E R

The Petition is filed by the petitioner to withdraw H.M.O.P.No.3562 of 2019 from the file of the Principal Judge, Family Court, Chenai and transfer the same to the file of the Subordinate Court, Alandur for proper and early disposal.

2. Heard the learned counsel for the petitioner and the learned counsel for the respondent.

3. Considering the fact that there appears to be a discord between the petitioner and the Presiding Officer, the petitioner has an apprehension in conducting the case before the learned Principal Judge, Family Court, Chennai. Though this Court does not endorse the contentions of the petitioner, however in the interest of justice the proceedings are now transferred with the consent of the learned counsel appearing for the respondent/wife to the file of the VI Additional Family Court, Chennai. The matter shall be called before the VI Additional Judge, Family Court, Chennai on 11.03.2022. It is also requested by the counsels that M.C.No.287 of 2020 also be transferred to the VI https://hcservices.ecourts.gov.in/hcservices/

Additional Family Court, Chennai. The learned Judge shall receive the counter filed in M.C.No.287 of 2020 and both the matters are to be tried together. Although the prayer is to transfer the matter to the Subordinate Court, Alandur, however on consent, the matters are transferred to the VI Additional Family Court, Chennai.

4. The Power Agent is directed to appear on all the hearings in the above matters. The learned counsel for the petitioner has given an undertaking to this Court that the petitioner will appear for adducing evidence in person.
