ORDER

This criminal original petition has been filed seeking to direct the second respondent herein to take further action on the complaint given by the petitioner dated 09.09.2019. 2.The gist of the case is that there was money transaction between the petitioner and Edwin Bosco, for which the law enforcing agency intervened and huge money was received as bribe from Edwin Bosco and further demand was also made. Since, the law enforcing agency in letter disregard to its duties failed to take anyaction, the petitioner made complaints on 26.12.2018 and 09.09.2019 to the law enforcing agency, but till date no proper action was taken by the law enforcing agency and hence this present petition.

The learned counsel appearing for the petitioner submits that it would suffice if a direction is issued to the second respondent to take appropriate action on the basis of the complaint given by the petitioner and also permit the petitioner to furnish the particulars before the law enforcing agency to prove their innocence and to further direct the law enforcing agency to complete the investigation within a time frame.

Learned Additional Public Prosecutor appearing for respondents on instructions, submits that after conducting preliminary enquiry, the matter was forwarded to the Government for appropriate action. In view of the amendment and Prevention of Corruption Act, as soon as the reply is received from the Government, appropriate action will be initiated and he further submits that investigation will be completed within the time frame fixed by this Court. 5.

Considering the limited request made by the learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor appearing for State, this Court without going into the merits of the case, is inclined to issue direction to the law enforcing agency to complete the investigation based on the complaint given by the petitioner, after giving opportunity to the petitioner to furnish materials to prove his innocence, within a period of twelve weeks from the date of receipt of a copy of this order. The petitioner is directed to co-operate with the law enforcing agency for early completion of the investigation. 6.This criminal original petition is disposed of. Consequently, connected miscellaneous petitions are also closed.
