Defendants Prayer: The Civil Suit has been filed under Order IV Rule 1 of the Original Side Rules read with Order VII Rule 1 of C.P.C. 1908, praying (i)for ordering specific performance of the contract dated 16.07.2008 entered into between the plaintiffs and defendants, directing the defendants to receive the balance of sale consideration of Rs.97,00,000/- from the
plaintiffs, directing the defendants to execute and register the sale deed in favour of the plaintiffs in respect of the suit property which is morefully described in the schedule hereunder, on or before the day to be fixed by this Court, failing which the Court may be pleased to execute the sale deed and register the same in favour of the plaintiffs in respect of the suit property and putting them into possession of the suit property; (ii) Granting permanent injunction restraining the respondents/defendants, their men, agent or agents, servant or servants or any other person or persons claiming through them or authorized by them from encumbering or alienating or dealing with the Suit property, which is mentioned in the schedule hereunder, by way of sale, mortgage, lease, lien, charge, joint development or otherwise till the specific performance is fully completed through the Court of Law;

JUDGMENT
(This case has been heard through video conference) The Plaintiff has filed a memo dated 31.08.2021 stating that the parties have entered into a compromise and the matter has been settled fully and amicably to the full satisfaction of both sides and seeks leave of this Court to withdraw the suit.
2.The said memo dated 31.08.2021 has been recorded and taken on file.
3. This Civil Suit stands dismissed as settled out of Court accordingly. The Registry is directed to refund the Court fee as per law.
