ORDER

The petitioner, who was arrested and remanded to judicial custody on 02.04.2025 based on execution of NBW issued against him in SPL.SC No.06 of 2013 on the file of the Special Judge for EC/NDPS Act cases, Salem for the offences punishable under Sections 8(c) r/w 20(b)(ii) (c), 25 of NDPS Act in Crime No.315 of 2012, registered on the file of the respondent police, seeks bail.

2.The case of the prosecution is that earlier he was arrested and released on bail. The petitioner is facing trial in SPL.SC No.06 of 2013 on the file of the Special Judge for EC/NDPS Act cases, Salem. He has not appeared for the hearing due to which NBW was issued to him on 02.05.2016 and he was arrested on 02.04.2025.

3.The learned counsel appearing for the petitioner submitted that he was not served with the summons and he was not aware of the pending of the case. Hence due to his non-appearance before the Trial Court NBW was issued as against him. He further submitted that the petitioner is ready to co-operate with the investigation and ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner. 4.The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioners, reiterated the prosecution case and submitted that the petitioner was served with the summons and the petitioner failed to appear, due to which NBW was issued against him. He further submitted that the case is posted for examination of witnesses on 04.03.2026 and the trial process is to be concluded.

5. Considering the facts of the case and the case is pending is from 2016, this Court is not inclined to grant bail to the petitioner. Accordingly, this criminal original petition stands dismissed.
