Writ petition filed under Article 226 of the constitution of India praying this Hon'ble Court to issue a writ of mandamus directing the respondents to count half of the service rendered by the petitioner as Plot Watcher from 01.01.1983 to till 06.08.2009 along with regular service rendered by the petitioner as Plot Watcher in the Supernumery Post from 07.08.2009 to 30.06.2014 as qualifying service for pensionary benefits and send the revised proposal to the 5th respondent for grant pension with all consequential monetary benefits.

AGNIHOTRI,J.,) It is submitted by the learned Government Advocate that the learned counsel appearing for the respondents 1 to 4 therein had given concession without obtaining instructions from the authorities and as such, the appellants may be permitted to take recourse to the review jurisdiction before the learned single Judge. An endorsement to that effect is made. Accordingly, the writ appeal is dismissed as withdrawn with liberty to take recourse to the review jurisdiction, if so advised, under the provisions of law. Consequently, M.P. No. 1 of 2014 is dismissed. No costs.
