The Member Secretary (SDAP) ..Respondent(s) Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus directing the respondents to consider the representation dated 4.09.2023 , 22.08.2025 , 29.01.2026 and 2.02.2026 submitted by the petitioner for disbursement of arrears of salary for suspension period from 2.09.2013 to 28.02.2014 (Totally 6 months) Difference in pay arrears from 2016- 2024 based on the order vide No. 1403/ SDAP/ Estt./ 2024- 25/ 37 dated 10.09.2024 passed by the Member Secretary SDAP and annual increments from 2013 to 2024 and 2 MACPs for completion of every 10 years due to stagnation in the single post for 20 years without any promotion and other monetary benefits due to petitioner from time to time with reasonable interest for belated payment Further direct respondents to issue probation declaration certificate and consequential confirmation order and also direct the

respondents to remit GPF Contribution amount deducted from petitioner salary for the period from 2008- 2019 before the concerned authority. For Petitioner(s):

ORDER

This Writ Petition has been filed for the following reliefs:- "directing the respondents to consider the representation dated 4.09.2023 , 22.08.2025 , 29.01.2026 and 2.02.2026 submitted by the petitioner for disbursement of arrears of salary for suspension period from 2.09.2013 to 28.02.2014 (Totally 6 months) Difference in pay arrears from 2016- 2024 based on the order vide No. 1403/ SDAP/ Estt./ 2024- 25/ 37 dated 10.09.2024 passed by the Member Secretary SDAP and annual increments from 2013 to 2024 and 2 MACPs for completion of every 10 years due to stagnation in the single post for 20 years without any promotion and other monetary benefits due to petitioner from time to time with reasonable interest for belated payment Further direct respondents to issue probation declaration certificate and consequential confirmation order and also direct the respondents to remit GPF Contribution amount deducted from petitioner salary for the period from 20082019 before the concerned authority."

The petitioner's main grievance is that though the disciplinary proceedings against him were withdrawn and despite obtaining favourable orders from this Court as well as the 6th respondent's order dated 10.09.2024 acknowledging his entitlement to full pay and allowances during the suspension period, the respondents to date have not provided him with several benefits, viz, his increments for several years have not been paid, his MACP benefits have not been given, his probation has not been declared even though he has completed 20 years of unblemished service, and the GPF amounts deducted from his salary between 2008 and 2019 have not been deposited with the concerned authority. Hence, the Writ Petition.

3. The learned counsel for the petitioner submitted that it would suffice if this Court directs the respondents to comply with the orders passed by the 6th respondent dated 10.09.2024 within a fixed time frame.

4. The learned Government Advocate appearing on behalf of the respondents submitted that the orders passed by the 6th respondent dated 10.09.2024 will be complied with by the respondents within a reasonable time frame.

5. Recording the above submissions the Writ Petition is disposed of with a direction that the order passed by the 6th respondent dated 10.09.2024 be given effect to within a period of one month. No costs. 06-03-2026 Index: Yes/No Speaking/Non-speaking order SHR To
