Petitioner seeks direction to the respondent to to conduct re-investigation and add Section 294(b) and 307 I.P.C. in the final report charge sheet in C.C.No.902 of 2016.
2. Heard learned counsel for petitioner and learned Government Advocate [Crl.side].
3.The contention of the petitioner is that in filing the final report, the respondent police have informed commission of offence under Section 326 of IPC and failed to inform commission of offence under Sections 294(b) and 307 I.P.C. https://hcservices.ecourts.gov.in/hcservices/
4.The filing of the final report by the police is not the be all and end all of the matter. Section 216 of Cr.P.C., empowers the Court to alter or add any charge at any time before judgment is pronounced.
5.Hence, this Criminal Original Petition is dismissed. Consequently, the connected miscellaneous petition is also closed.
