This petition is filed to condone the delay of 90 days in filing the above Second Appeal.

2. Heard the learned counsel for the petitioner as well as the learned counsel for the respondents.

3. The learned counsel for the respondents has no objection for condoning the delay.

4. In view of the no objection expressed by the learned counsel for the respondents and being satisfied with the reasons stated in the affidavit filed in support of the petition this petition is allowed and the delay of 90 days in filing the second appeal is condoned.

5. The Registry is directed to print the name of Mr.T.L.Thirumalaisamy, learned counsel appearing for R4.
