PRAYER: Criminal Original Petition filed under Section 482 of the Cr.P.C., to call for the records pertaining to C.C.No.226 of 2014 on the file of the Fast Track Court No.I (Magistrate level) at Coimbatore, and quash the said complaint as against the petitioner.

O R D E R

This petition has been filed by the petitioner to quash the proceedings in C.C.No.226 of 2014 pending on the file of the Fast Track Court-I (Magistrate level), Coimbatore.

2. This quash petition has been filed mainly on the ground that the petitioner is willing to pay the entire cheque amount of Rs.23,000/- to the respondent. The proceedings have been initiated in the year 2014 and the petitioner had filed a memo in the year 2015 stating that he is willing to repay back the entire cheque amount of Rs.23,000/- and in fact a Demand Draft for a sum of Rs.23,000/- was also enclosed along with the memo. This proposal was not accepted by the respondent.

3. It is seen from the case status that the trial is already complete and final arguments are also over. At this stage, this Court cannot interfere with the proceedings. It is left open to the Court below to consider the offer made by the petitioner to repay back the entire cheque amount and deal with the same in accordance with law.

5. This Criminal Original Petition is disposed of with a direction to the court below to complete the proceedings within a period of two months from the date of receipt of a copy of this order. Consequently, connected Miscellaneous Petitions are also closed.
