The Government Of Tamil Nadu, v. N. Nagarajan
C.M.P. No. 15214 of 2016 in W.A.SR No. 69635 of 2016 K.K. SASIDHARAN,J.
AND P.D. AUDIKESAVALU,J.
(Order of the Court was made by K.K. SASIDHARAN,J.) This petition is filed to condone the delay of 232 days in filing the intracourt appeal challenging the order dated 18 January, 2016 in W.P. No. 39717 of 2015.
2.
There is no reason much less any justifiable reason given by the petitioners for condoning the delay. The petitioners should have at least given minimum reasons for condoning the delay. It is true that each day's delay need not be explained. However, in a case of this nature, the petitioners ought to have given convincing reasons for condoning the delay. 3.
The affidavit filed in support of the miscellaneous petition indicates that in similar circumstances, this Court has already entertained such intracourt appeals. 4.
In view of the pendency of the matter before this Court, more particularly, the batch relating to counting of 50% of earlier service, we condone the delay subject to the condition that the petitioners shall pay a sum of Rs.10,000/- (Rupees Ten Thousand only) by way of costs to the respondent. http://www.judis.nic.in K.K. SASIDHARAN,J.
AND P.D. AUDIKESAVALU,J.
nv 5.
Let the cost amount be paid to the respondent and a copy of the receipt be produced before this Court positively by 25 April, 2019 failing which the miscellaneous petition will be summarily rejected without any further reference to this Court.
