PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of Mandamus,directing the respondents 1 and 2 take necessary action in order to protect the life and liberty of the petitioner and her husband Mr.Sidhaanandam against all possible actions by respondents 3 to 5, their men, agents or representatives, etc., For Petitioner : Mr.K.C.Karl Marx For Respondents : Mr.Mohammed Riyaz Addl. O R D E R
The Writ Petition has been filed by the petitioner under Article 226 of the Constitution of India, praying to issue a writ of Mandamus, directing the respondents 1 and 2 take necessary action in order to protect the life and liberty of the petitioner and her husband Mr.Sidhaanandam against all possible actions by respondents 3 to 5, their men, agents or representatives, etc., 2.The learned counsel for the petitioner would submit that the petitioner fell in love with one Sidhaanandam who belongs to some other community. The petitioner has attained majority and left her paternal home on 02.01.2019 and got married with her husband on 23.01.2019 at Sri Chelliamman Temple at Vasur Village, Polur Taluk, Thiruvannamalai District and their marriage also got registered at SubRegistrar Office, Polur. As her husband belongs to some other community, the respondents 3 to 5 who are none other than the father and the close relatives of the petitioner continuously threatening them with dire consequences.
3.The learned counsel would further submit that since the marriage is the intercaste marriage, the parents of the petitioner are not accepting the same and with the support of the 2nd respondent, they
are searching them. Now the petitioner and her husband are living in some other place. Accordingly, prays for the protection of life and liberty of the petitioner.
4.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.
5.In the interest of justice, this Court also interacted with the petitioner and her husband. They got married and living happily.
Considering the facts and circumstances of the case, this Court inclined to direct the respondents 1 & 2 to provide adequate police protection to the petitioner and her husband's life and liberty forthwith. 6.Accordingly, this writ petition stands allowed.
