ORDER

The petitioner / Accused, who apprehends arrest in the hands of the respondent police for the offence punishable under Sections 123 of B.N.S. in connection with the Cr. No.371 of 2024, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the defacto complainant's brother purchased Tanpantadol pills from the accused and subsequently he died on 06.10.2024 due to excess consumption of drug tablets. Hence the case .

3. The learned counsel for the petitioner would contend that the respondent police have registered a false case against the petitioner for the offences 123 of B.N.S; that the petitioner has not committed any offence, that he has been falsely implicated in this case; that the petitioner has been arrayed as an accused in this case, only based on a confession statement of the co-accused; that the first anticipatory bail application was dismissed on the ground that investigation was at initial stage, that the investigation is completed and hence prayed to grant anticipatory bail to the petitioner.

The learned Government Advocate (Criminal Side) would submit that the accused have illegally sold the drugs tablets to the general public through online; that the petitioner has two previous cases of similar nature; that the Investigation is not yet completed; and hence, opposed the grant of anticipatory bail to the petitioner.

5. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) for the respondent and also perused the materials available on record.

6. Considering the nature of allegations, the fact that earlier anticipatory bail application was dismissed by this Court vide order dated 21.12.2024, the

msv petitioner has two previous cases which are similar in nature and that there is no change in circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
