(Order of the Court was made by R.MAHADEVAN, J.) This petition has been filed by the petitioners seeking leave of this court to file the above writ appeal against the order dated 09.01.2024 passed by the learned Judge in W.P.No.250 of 2024.

The learned counsel for the petitioners submitted that the first respondent issued a G.O.Ms.No.149 School Education (TRB) Department dated 20.07.2018 stating that the selection will be made only among the eligible candidates on the basis of a competitive examination. Aggrieved by the same, similarly placed persons like that of the petitioners herein, already approached the writ court by filing WP.No.250 of 2024 challenging the validity of the said G.O. and for directing the authorities to make direct recruitment to the post of Secondary Grade Teachers / Primary School Teachers or Graduate Teachers / BT Assistants as the case may be in Government schools without recourse to the competitive written examination, but on the basis of TET marks and TET passed seniority or any other method of selection to be adopted by the state Government.

The learned Judge, by order dated 09.01.2024, dismissed the said writ petition. According to the learned counsel, the petitioners, who are third parties to the writ petition, sought leave to prefer a writ appeal against the said order of the learned Judge and therefore, this miscellaneous petition. https://www.mhc.tn.gov.

Heard the learned Additional Advocate General appearing for the respondent authorities, who has no objection for granting such relief to the petitioners.

Considering the reasons stated in the affidavit filed in support of this petition and being satisfied with the same, this Court is inclined to grant leave to the petitioners to file the above appeal. Accordingly, this petition is ordered as prayed for.
