Prayer: Writ Petition filed Under Article 226 of the Constitution of India praying for issuance of Writ of Certiorarified Mandamus, calling for the records relating to the impugned proceedings of the second respondent in Se.Mu.Aa.No. Aa.Aa1/34503/08 dated 01.03.2010 quash the same and direct the respondents 1 and 2 to promote the petitioner as Assistant Conservator of Forests with retrospective benefits based upon the petitioner's seniority in the cadre of Forest Rangers.

This writ petition is filed seeking for Certiorarified Mandamus, to quash the impugned proceedings of the second respondent in Se.Mu.Aa.No. Aa.Aa1/34503/08 dated 01.03.2010 and direct the first and second respondent to promote the petitioner as Assistant Conservator of Forests with retrospective benefits based upon the petitioner's seniority in the cadre of Forest Rangers.

2. In view of the statement made in the counter affidavit that in Vatchathi Criminal Case, sentence was awarded. This Court has suspended the sentence awarded by the Principal District Judge, Dharmapuri till the disposal of the Criminal Appeal filed by the petitioner before this Court. Subsequently, the punishment imposed by the Prinicipal District Judge, Dharmapuri is confirmed by this Court. Now, the same is pending before the Hon'ble Supreme Court of India.

3. In view of the submission made by the learned Government Advocate appearing for the first to third respondent, nothing survives in this writ petition for further adjudication.
