PRAYER: Civil Revision Petition filed under Article 227 of Constitution of India, praying to direct the learned District Principal Sub-Court, Kallakurichi to dispose the suit in O.S.No.202 of 2021 within the time stipulated. For Petitioner :M/s.S.N.Subramani 1/4

ORDER

The Civil Revision Petition is filed seeking a direction to Principal SubCourt, Kallakurichi to dispose of the suit in O.S.No.202 of 2021 within a time frame fixed by this Court.

2. Having regard to the limited prayer made by the petitioner in this revision, this Court is inclined to dispose of the same even without notice to the respondents.

3. The petitioner is the 4th defendant in the suit. The 1st respondent herein filed a suit for declaration of his title and injunction. He also sought for a declaration that settlement deed executed by deceased husband of 1st defendant in her favour was null and void. He further prayed for a declaration of sale deed executed by 1st defendant in favour of petitioner herein/4th defendant was also null and void.

A perusal of e-court status filed in the typed set of papers would suggest that written statement was filed in the suit as early as 18.03.2022 and thereafter, the matter has been adjourned from time to time for framing of issues without any progress. In view of the fact that suit is of the year 2021, this Court is inclined to issue a direction to Principal Sub-Court, Kallakurichi to dispose of the suit as expeditiously as possible.

5. With this direction, this Civil Revision Petition is disposed of. No costs.
