Respondents PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to call for the records with respect to the final report filed in CC.No.24 of 2021 before the Judicial Magistrate at Uthukottai and set aside the same and consequently direct the respondent police to further investigate the case in Crime No.1462 of 2020 on the file of the 2nd respondent police and file a final report within the time frame stipulated by this Court. ORDER

This criminal original petition has been filed to call for the records with respect to the final report filed in CC.No.24 of 2021 before the Judicial Magistrate at Uthukottai and set aside the same and consequently direct the respondent police to further investigate the case in Crime No.1462 of 2020 on the file of the 2nd respondent police and file a final report within the time frame stipulated by this Court.

2.The learned Additional Public Prosecutor on instructions submitted that the trial has already commenced in this case and the case is posted tomorrow for examination of LW5 to LW7.

3.In view of the above, the relief as sought for by the petitioner for a direction to further investigate this case cannot be sustained at this length of time. 4.Accordingly, this criminal original petition stands dismissed. 28.02.2024 Index : Yes/No Internet : Yes/No Speaking Order/Non-Speaking Order ssr
