The above Petition is filed to withdraw and transfer HMOP.No.261 of 2023 pending on the file of the Sub-Judge, Kovilpatti to the Family Court Judge, Chennai. 1/4
2. Reasons for seeking the transfer are as follows:- (i) The petitioner/wife who is the sole bread winner for the family is residing along with her mother and son in Chennai. (ii) The Sub Court at Kovilpatti has no jurisdiction to entertain the above HMOP case.
(iii) The respondent/husband is presently residing in America.
3. Heard the learned counsel on either side.
4. In the above circumstances, the request for transfer appears reasonable. Therefore, the Transfer Civil Miscellaneous Petition is allowed and HMOP.No.261 of 2023 pending on the file of the SubJudge, Kovilpatti is withdrawn and transferred to the file of the Family Court Judge, Chennai. No costs. Consequently, the connected Miscellaneous Petition is closed.
