2. Offences alleged are under Sections 452, 353, 392 IPC r/w Section 3(1) of TNPPDL Act in Crime No.215 of 2017.
3. Heard both sides.
4. Near petitioner's college, viz., Kandasamy Naidu College, Anna Nagar Roundana, there is a TASMAC shop. They are selling liquor to students or adult persons, who are giving money. There are incidents that the college students were going to the shop and purchasing the liquor out of the money given by their parents. On the occurrence day, an untoward incident took place. The Manager of TASMAC shop lodged a complaint stating that certain students of nearby college have indulged in violent activities, taken away certain bottles and broken away billing machine.
5. Learned counsel for the petitioner submitted that petitioner is a student and he along with others conducted protest against selling of liquor. Enraged by the same, the petitioner has been implicated in the case. Learned counsel for the petitioner also submitted that petitioner is a student and he is studying B.Com course in a college in Chennai and he has written competitive examination.
6. Petitioner is only 19 years old. He is in middle of his academic career. Sometimes, the students fell in the company of bad students. Some will overcome the same and some will fall a prey to it. Taking note of pitiable plight of parents, if the petitioner is arrested, his career will be ruined.
7. In the facts and circumstances, I am inclined to grant him anticipatory bail.
8. Ordered as under:- (i) Anticipatory bail granted to the petitioner; (ii) Petitioner shall surrender before the learned V Metropolitan Magistrate, Egmore, within 15 days of receipt of a copy of the order;
(iii) Petitioner shall execute a bond for Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the said Magistrate;
(iv) Either of the parents of petitioner shall stand as a surety;
(v)Petitioner shall appear before the respondent police as and when required for interrogation.
