....Respondents PRAYER: Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the learned Metropolitan Magistrate For Exclusive Trail of CCB and CBCID Metro Cases, Chennai to return back the document, Settlement deed dated 18.11.2016 having Document No.4265/2016 on the file of No.2, Joint Sub-Registrar, Cuddalore, deposited with the court on 18.01.2017 in X.Crime No.577 of 2006 on the file of Sub Inspector of Police, Central Crime Branch, IV- Team, Egmore, Chennai -8, which was closed on 06.08.2013 by the Chief Metropolitan Magistrate Egmore, Chennai-8, to the petitioner and pass other appropriate orders.

ORDER

This petition has been filed for a direction to the Court below to return back certain documents which was deposited before the Court below, in view of the case itself being closed on 06.08.2013.

2.The case of the petitioner is that he had deposited certain documents before the Court below pursuant to the conditions imposed by this Court while disposing Crl.O.P.No.30225 of 2006 by an order dated 11.07.2008. The further case of the petitioner is that FIR itself has been closed and protest petition filed was also dismissed by an order dated 06.08.2013 by the learned Chief Metropolitan Magistrate, Egmore.

3.The petitioner had sought for the return of the documents on the ground that the main case itself has been closed. 4.Taking into consideration the facts and circumstances of the case, the Court below is directed to return back the documents deposited by the petitioner, if it has not already been handed over to the petitioner.

5.This criminal original petition is disposed of with the above direction.
