These petitions have been filed seeking (i) to condone the delay in setting aside the abatement of the second appeal caused due to the death of 1st Appellant, Shanmugam; (ii) to set aside the abatement and; (iii) to bring on record the proposed respondents 4 to 7 as the legal representatives of the deceased 1st appellant.

2. In view of the above, the delay of 2266 days is condoned. Accordingly, the condone delay petition is allowed. Consequently, the petitions to set aside the abatement and to bring on record the legal representatives of the deceased 1st appellant, Shanmugam are hereby allowed. 29.10.2025 rpl Note: The Registry is directed to carryout necessary amendment in the second appeal R.N.MANJULA,J.
