Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.S.P.YUARAJ, Advocate for the petitioner and of MR.D.BASKARAN, Advocate on behalf of the 1st Respondent, the court made the following order:- This petition is filed to permit the petitioner herein to withdraw the entire amount deposited to the credit of MCOP No.376 of 2012 on the file of Motor Accident Claims Tribunal Special Sub Court No.1, Salem.
2. It is seen from the order of this court dated 24.01.2017 passed in C.M.P.No.755 of 2017 that the appellant/Insurance company was directed to deposit entire amount.
3. In view of the submissions made by the learned counsel appearing on behalf of the petitioner/claimant this Court is inclined to permit the petitioner to withdraw 25% of the award amount lying in the credit of M.C.O.P.No.376 of 2012.
4. This petitioner is ordered accordingly.
