This petition has been filed to direct the learned II Metropolitan Magistrate Court, Egmore, Chennai, to return the passport of the petitioner to him, surrendered in connection with crime No.1314 of 2016, on the file of the Inspector of Police, D-3, Ice House Police Station, Triplicane, Chennai in Crl.O.P.No.26717 of 2016, dated 21.12.2016.

2.The learned counsel for the petitioner submitted that the said crime number had been closed as mistake of fact by the respondent police on 01.03.2022. However, the passport of the petitioner had not been returned to him.

3.The learned Government Advocate (Crl.Side) also submits that the case against the petitioner has been closed as mistake of fact and there has been no objections filed by the defacto complainant. 4.In such circumstances, I am of the view that the petitioner is entitled to the return of the passport. Since the petitioner's passport had been deposited with the learned II Metropolitan Magistrate Court, Egmore, 1/3

Chennai, I am of the view that the petitioner can make necessary application before the said Court seeking for return of the passport. As and when such an application is filed, the learned II Metropolitan Magistrate, Egmore, Chennai, is directed to consider the application on the same day and pass appropriate orders.
