PONGIAPPAN CRIMINAL MISCELLANEOUS PETITION No.2812 of 2022 IN CRL.RC.NO.277 OF 2022 A.SURESH KUMAR [ PETITIONER ] Vs S.SINDHU [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in CRL.RC.NO.277 of 2022 on the file of the High Court, the High Court will be pleased to stay the operation of the order dated 18.12.2021 made in M.C.No.244 of 2017 on the file of the Additional Principal Family Court, Coimbatore, pending disposal of the above CRL.RC.NO.277 OF 2022.

Order : This petition coming on for orders upon perusing the petition and Memorandum of Grounds in CRL.RC.NO.277 of 2022 On the file of the High Court and upon hearing the arguments of M/S. K.GOVI GANESAN, Advocate for the petitioner the court made the following order:- This miscellaneous petition has been filed praying to stay the operation of the order dated 18.12.2021 made in MC.No.244 of 2017 on the file of the learned Additional Principal Family Court, Coimbatore pending disposal of the above criminal revision case.

2. The learned counsel appearing for the petitioner fairly admits as of now, the petitioner is liable to pay total arrear amount of Rs.3,67,500/- to the respondent. Further he is ready to deposit 50% of the said amount to the credit of M.C.No.244 of 2017 before the learned Additional Principal Family Court, Coimbatore and also he is not having any objection to disburse the said amount to the respondent. It is the specific submission made by the learned counsel for the petitioner that the petitioner is ready and willing to deposit 50% of the monthly maintenance amount as ordered by the trial court continuously without fail.

Considering the submission of the learned counsel for the petitioner, there shall be an order of interim stay of the operation of the order dated 18.12.2021 made in MC.No.244 of 2017 on the file of the learned Additional Principal Family Court, Coimbatore on condition that the petitioner shall deposit 50% of the arrear amount to the credit of M.C.No.244 of 2017 before the learned Additional Principal Family Court, Coimbatore within a period of four weeks from the date of receipt of copy of this order. Further, the petitioner shall deposit 50% of the monthly maintenance amount to the credit of M.C.No.244 of 2017 before the learned Additional Principal Family Court, Coimbatore on or before 5th day of every English Calendar month without fail. On such deposit, the learned Additional Principal Family Court, Coimbatore is directed to disburse the same to the respondent, who is claiming maintenance, then and there.

4. Post the matter after four weeks.
