Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, to call for the records on the file of the second respondent relating to the order issued in Roc.24859/2008/C1 dated 18.11.2011 and quash the same and consequently direct the respondents to appoint the petitioner to the post of Selection Grade Municipal Commissioner with effect from 15.12.2010 the date on which his junior was promoted with consequential service and all other attendant benefits such as fixation of pay, arrear of salary, fixation of pensionary benefits based on such promotion.

ORDER

This matter earlier came up for consideration before this Court on 25.10.2024, 29.01.2025 and 04.07.2025. All the three occasions, there was no representation for the petitioner. Hence, the same was directed to be listed under the caption "for dismissal". Today, inspite of matter being listed under the caption "for dismissal, there is no representation for the petitioner either in the pre-lunch or post-lunch session.

2. In view of the same, this Court is left with no other option except to dismiss the writ petition for non-prosecution. Accordingly, this Writ Petition is dismissed for non-prosecution. No costs. Consequently, connected miscellaneous petition is closed.
