PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the respondent herein to comply with the order passed in C.M.P.No.405 of 2023 dated 11.7.2023 by the learned District Munsif cum Judicial Magistrate, Pallavaram, to investigate the case further and to file a final report accordingly if prima facie case is made out in Crime No.542 of 2021 on the file of the respondent police.

ORDER

This Criminal Original Petition has been filed to direct the respondent herein to comply with the order passed in C.M.P.No.405 of 2023 dated 11.7.2023 by the learned District Munsif cum Judicial Magistrate, Pallavaram, to investigate 1/4

the case further and to file a final report accordingly if prima facie case is made out in Crime No.542 of 2021 on the file of the respondent police. 2.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the respondent. 3.The learned counsel appearing for the petitioner would submit that though the respondent has registered a case in the above said crime number on 11.10.2021, no final report is filed till date. 4.The learned Additional Public Prosecutor appearing for the respondent would submit that the respondent police may be permitted to file a final report within a period of two months.

5.In view of the above, the respondent police is directed to either file a final report or closure report, as the case may be, within a period of two months from the date of receipt of a copy of this order under due intimation to the defacto complainant.
