Respondent Contempt Petition has been filed under Section 11 of the Contempt of Courts Act, 1971, to punish the respondent for wilful disobedience of the order passed by this Court in W.P.No.19980 of 2020, dated 23.12.2020. For Petitioner : Mr.S.Parthasarathy, Senior Counsel, for Mr.P.Udhayashankar.
For Respondent : Mr.J.Ravindran, Addl. Advocate General, assisted by Mr.A.Selvendran, Special Government Pleader.
ORDER
2/4 (By S.Vaidyanathan,J.) Mr.A.Selvendran, learned Special Government Pleader, appearing for the respondent-Government, submits that the encroachments have been removed, which fact has been disputed by Mr.S.Parthasarathy, learned Senior Counsel, appearing for the petitioner. He further submits that there is an encroachment by the petitioner also and that he would remove the said encroachment and ensure that the Eri-Poramboke is restored.
2. Taking note of the submissions that there will be no encroachments in the marked portions in the Sketch at Page 9 of the Typed Set of Papers, which is scanned below, we make it clear that the said encroachments shall be removed, if not already done. The sketch reads as under :
3/4 We also make it clear that no further encroachment shall be made by any of the parties in Eri-Poramboke and, if it is brought to our attention about any encroachment in future, serious view will be taken note of on such violation, and this Court may impose imprisonment on such violator(s).
3. Contempt Petition is, accordingly, closed. No costs.
