Prayer:- Petition filed under Section 482 of Criminal Procedure Code praying to direct the Special Metropolitan Magistrate, Periyamed at Chennai to split up the case in C.C. No.5718 of 2010 (re-numbered as C.C. No.66 of 2013) in the caption of Land Grabbing Cases and expedite its trial as earlier as possible within a short period that may be fixed by this Court.

Petition filed under Section 482 of Criminal Procedure Code to direct the Special Metropolitan Magistrate, Periyamed at Chennai to split up the case in C.C. No.5718 of 2010 (re-numbered as C.C. No.66 of 2013) in the caption of Land Grabbing Cases and to expedite its trial, as earlier as possible within a stipulated time that may be fixed by this Court.
2.Learned Additional Public Prosecutor submitted that Land Grabbing cases have already been stayed by this Court. 3.Learned counsel for the petitioner submitted that originally a case has been registered in Crime No.34 of 2009 dated 28.01.2009 under Sections 465, 468, 461, 474, 420 read with 120(b) of IPC against the land grabbers before the learned XI Metropolitan Magistrate, Saidapet in C.C. No.5718 of 2010 prior to the constitution of the Special Court and thereafter, it was transferred to the Special Metropolitan Magistrate, Periyamed, Chennai and renumbered as C.C. 4.Materials on record discloses that a final report has been filed in C.C. No.5718 of 2010 and the case has been re-numbered as C.C. No.66 of 2013 and stated to be pending on the file of the learned Special Metropolitan Magistrate, Chennai. When this Court has granted stay of the G.O., direction prayed for by the petitioner, cannot be granted. Contentions made by the learned counsel for the petitioner cannot be accepted, as trial in respect of Land Grabbing Cases has also been stayed.
5.For the reasons stated above, this Criminal Original Petition is dismissed.
