Respondents Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the 1st and 2nd respondents to conduct enquiry and pass orders on the Petitioners representation dated 02.12.2021 for cancellation of patta No. 1828 issued in respect of the Survey No. 61/2B to the 3rd respondent and for issuance of patta for land measuring an extent of 32 cents comprised in survey No. 61/2B of Sirukundram Village Thiruporur Taluk Chengalpattu District in our favour. O R D E R

The prayer sought for herein is for a Writ of Mandamus directing the 1st and 2nd respondents to conduct enquiry and pass orders on the Petitioners representation dated 02.12.2021 for cancellation of patta No. 1828 issued in respect of the Survey No. 61/2B to the 3rd respondent and for issuance of patta for land measuring an extent of 32 cents comprised in Survey No. 61/2B of Sirukundram Village Thiruporur Taluk Chengalpattu District in his favour. 2.In respect of the property at Survey No. 61/2B of Sirukundram Village Thiruporur Taluk Chengalpattu District it is the grievance of the petitioner that the patta granted by the Revenue Tahsildar in the name of the 3rd respondent has to be cancelled. Therefore, he filed an appeal dated 02.12.2021 to the 1st respondent Revenue Divisional Officer and in order to consider the same and to dispose of the said appeal he has preferred the present writ petition.

3. Heard Mr.S.M.Muralidharan, learned counsel for the petitioner and Mr.R.P.Muruganraja learned Government Advocate for the respondents.

4. Learned Government Advocate submits that the said appeal filed by the petitioner would be considered and after hearing both the petitioner as well as the 3rd respondent, the said appeal would be decided and final orders would be 2 / 4

passed within a time frame that may be stipulated by this Court.

5. Considering the said submission made by the learned Government Advocate, there shall be a direction to the 1st respondent to consider the appeal filed by the petitioner dated 02.12.2021 and after hearing both the petitioner as well as the 3rd respondent, pass necessary orders thereon on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.
