Crl.M.P.No.2455 of 2022 in Crl.A.SR.No.8059 of 2022 R. PONGIAPPAN, J This petition is filed to condone the delay of 1197 days in filing the Criminal Appeal against the judgment passed by the learned Sessions Judge, Fast Track Mahile Court, Ariyalur in Spl.S.C.No.15 of 2016 dated 05.10.2016.

2. Heard the learned Counsel for the petitioners as well as the learned Government Advocate (Crl.

Side) appearing for the respondent police.

3. The petitioner is an accused convicted and sentenced to undergo 10 years rigorous imprisonment and also imposed fine amount of Rs.1000/- and in default to undergo simple imprisonment for 6 months. Since the petitioner is having the right to challenge his conviction under appeal, the delay in preferring the appeal is immaterial.

3. Being satisfied with the reasons stated in the affidavit filed in support of the petition, the delay stands condoned and the petition is allowed.
