The background facts:-
2. The petitioners were all appointed on temporary basis in various District Courts in view of the inability expressed by the Tamil Nadu Public Service Commission to undertake regular recruitment process. Some of the petitioners completed more than five years of temporary service. The appointments were made through the employment exchange taking into account the seniority position.
3. The immediate cause for filing the Writ Petitions appears to be the issuance of notifications by the District Courts calling for applications for appointment to various posts on regular basis. The petitioners seek benefit of the earlier orders directing regularization of the services of temporary employees and the compliance of such orders by the High Court by issuing proceedings in ROC No.588/A/ 2006/C3 dated 29 March 2017.
4. The counter affidavit filed by the District Judges of Erode and Tiruvallur, contain the details of the posts advertised and their objection to the plea for regularization.
5. The details furnished by the Registry shows the temporary appointments made across the State by the District Judges of the concerned Districts.
Submissions:-
6. The learned counsel for the petitioners submitted that the petitioners would be satisfied in case a direction is given to consider the case of the petitioners along with others for appointment, by giving them age relaxation and preference. According to the learned counsel for the parties, the petitioners have spent considerable period in the judiciary pursuant to the temporary appointments made by the District Judges of the concerned districts and they should be given opportunity to serve the judiciary on permanent basis.
7. We have also heard the learned counsel for the High Court and the learned Special Government Pleader for the State. Discussion :-
8. The names of the petitioners were sponsored by the employment exchange for temporary appointment in various posts in the District Judiciary. The appointments were made, making it very clear that it would continue only till regular appointments are made. It is matter of record that the communal rotation was not taken into account while making appointments. In fact, it was only a stop gap arrangement, taking into account the
difficulties experienced by the District Judiciary on account of short of manpower. The petitioners have therefore, no right to claim regularization on account of their past service.
9. The earlier orders and its compliance :- (i) The Division Bench by order dated 7 March 2006 in W.P.No.16321 of 2001 etc. batch, directed the Principal District Judge, Tirunelveli, to regularize the appointment of the temporary employees, who were the petitioners in the Writ Petitions;
(ii) The Division Bench by order dated 24 March 2006, in W.P.No.10132 of 2005, directed regularization of the services of 13 temporary employees in the City Civil Court at Chennai;
(iii) The High Court, by proceedings in ROC No.588/A/2006/C3 dated 29 March 2017, implemented the order dated 7 March 2006 and 24 March 2006 and even extended the benefits to others, who were not parties to the Writ Petitions by regularizing their services;
(iv) The High Court by order dated 10 March 2009 in W.P.No.9710 and 10189 of 2009, protected the interest of the temporary employees, who were ousted consequent to the direct recruitment made to the posts, by accommodating them in other posts;
(v) The Division Bench by order dated 19 October 2010, in W.P.No.3462 of 2010 dismissed the Writ Petition filed by the temporary employees for regularization;
(vi) The Division Bench by order dated 22 November 2012 in W.P.No.30871, 30881 and 31036 of 2012, while negativing the plea for regularization of services of temporary court employees, directed the Principal District Judge to give preference and age relaxation to them while making regular selection;
(vii) The Division Bench by order dated 21 November 2014 in W.P.No.29656 of 2013, rejected the request for regularization of temporary employees of Vellore Judicial District;
(viii) The Division Bench by order dated 27 November 2014 while rejecting the claim for regularization made by the temporary employees of the Districts of Kanyakumari, Vellore, Nagapattinam, Tiruvannamalai, Perambalur, Kanchipuram, Tiruvarur, Erode, Villupuram, Tirunelveli, Ariyalur, Dharmapuri, Tanjore, Cuddalore, Ramanathapuram, Madurai and City Civil Court, Chennai, directed the respective District Courts to give them age relaxation and preference while making appointments on regular basis.
(ix) The Government of Tamil Nadu by letter No.20426/Cts-V/2015-1 dated 28 May 2015 rejected the request made by the Registry of the High Court for conducting a special competitive examination for regularizing the services of Typist/ Stenotypist / Junior Assistant appointed on temporary basis.
(x) The Division Bench by order dated 1 February 2017 in W.P.No.2206 to 2212 of 2017 and 2213 to 2218 of 2017, without agreeing with the claim for regularization of temporary employees of Tiruvallur District, directed consideration of their case for regular appointment by giving them age relaxation and preference.
(xi) The Division Bench by order dated 21 March 2017 in W.P.No.27895 of 2014 directed the District Judge, Salem, to give age relaxation and preference to the temporary employees of Salem District.
(xii) The Division Bench by order dated 19 April 2017 in W.P.No.42870 to 42875 of 2016, again directed considering the case of temporary employees of Villupuram District for regular appointment by giving them age relaxation and preference and rejected the prayer for framing a scheme for regularization.
(xiii) Two Division Benches of this Court by order dated 13 March 2018 and 19 June 2017, in W.P.Nos.37448 of 2016 and 19429 of 2017, rejected the claim of two employees whose services were regularized,
for counting the past service as temporary employees for seniority and grant of other benefits;
(xiv) The Division Bench, of which one of us was a party (K.K.S.J.), in its order dated 30 October 2018 in W.P.No.26044 of 2018 etc. batch, while rejecting the claim for regularization in any of the suitable posts, directed the District Judge, Coimbatore, to give them age relaxation and preference while making regular appointment.
(xv) The Division Bench of this Court by order dated 7 December 2018, in W.P.No.14287 to 14294 of 2018, without issuing a direction for regularization in any of the suitable posts, directed the Government to consider and dispose of the representations for regularization.
Plea for regularization :-
10. The claim made by the temporary employees of District Courts for regularization were considered and rejected by various Division Benches, the exception being the orders passed in W.P.No.16321 of 2001 etc. and W.P.No.10132/2005 without deciding the law on the subject. We are therefore of the view that the temporary appointees are not entitled for regularization of their services.
The vacancy position:-
11. The District Courts across the State issued notifications for appointment against several posts lying vacant now. The huge vacancy position and the date of sanctioning the posts clearly indicate that majority of the District Judges have not taken earnest efforts for filling up the posts for reasons best known to them. Instead of resorting to the method of direct appointment, some of the District Courts have adopted the method of temporary appointments, which resulted in the mushroom growth of Writ Petitions at the instance of the temporary employees for regularization. It should be the endeavour of the District Courts and the Tamil Nadu Public Service Commission to fill up all the sanctioned posts without any delay.
Resolution of the issue :-
12. (a) The petitioners, who were appointed temporarily under Rule 10a(i) of the Tamil Nadu State and Subordinate Services Rules through employment exchange and by following a
transparent procedure of appointment, must be given an opportunity to take part in the selection process for regular appointment with due weightage to their earlier service. This Court had issued several directions for giving age relaxation and preference to the temporary employees while filling up the posts on regular basis.
(b) The District Judges of the concerned Districts are the appointing authorities for the posts notified for appointment. In view of the direction given by the Hon'ble Supreme Court in the order dated 17 January 2019 in Civil Appeal No.1867/2006 and the office memorandum issued by the High Court dated 8 February 2019, the District Judges are obliged to notify the vacancies and complete the recruitment process on or before 16 July 2019. After the regular appointment, there should not be any kind of temporary appointment in the District judiciary. (c) The temporary employees, whose services were terminated and those who are still in service must be given an opportunity to seek permanent appointment, of course by taking part in the regular selection process. They are also entitled to preference in view of the earlier orders passed by this Court, the latest being the order dated 30 October 2018, in W.P.No.26044 of 2018 etc. batch. This will be a one time measure to address their grievances.
(d) Since the District Judiciary across the State are in the process of regular recruitment, we are of the view that a uniform method of selection should be followed, instead of each district Court following its own selection criteria. We are arriving at this conclusion on account of the separate notifications issued by the District Courts without any uniformity in the procedure and even in respect of age criteria. (e) Since it is a time bound selection process initiated by the Courts pursuant to the direction given by the Hon'ble Supreme Court and the consequential office memorandum issued by the High Court, we are of the view that appropriate direction should be issued in the matter of selection.
We issue the following directions, in the nature of guidelines, for compliance by the Subordinate Judiciary across the State, for appointment to various posts, taking into account the spirit of the earlier orders passed by this Court. Directions:- (i) The District Judges of the Districts and other appointing authorities of the
Subordinate Courts across the State are directed to issue notification for appointment forthwith, in case of failure to issue notification so far calling for applications for filling up all the vacant posts except the posts to be filled up by the Tamil Nadu Public Service Commission taking into account the order dated 17 January 2019 in Civil Appeal No.1867/2006 and the office memorandum issued by the High Court dated 8 February 2019.
(ii) The age limit for different categories would be as below, and as indicated in the notification issued by the Principal District Judge, Madurai. In case a different age limit is prescribed, in any of the notifications issued by other District Courts, the age criteria in such notifications stand modified as follows.

(iv) The employees who have worked temporarily earlier and terminated or who are working as on date are eligible to apply for different posts taking into account the
communal roster. De hors the nature of post and present employment, the temporary employees are given liberty to apply for any of the posts of their choice in any of the Districts, subject to fulfilling the educational qualification prescribed for the particular post and communal roster.
(v) The temporary employees along with their application must produce the employment certificates issued by the Courts, where they have worked or working at present. We direct the District Judges, and other Subordinate Courts to issue certificates to the temporary employees on application, indicating the total period of service. The certificate shall be issued forthwith so as to enable the temporary employees to apply within the time prescribed in the notification or the extended period indicated in this order. In case of difficulty in obtaining certificate of temporary employment, it would suffice in case specific mention is made in the application indicating the temporary service and an undertaking to produce certificate before the date notified for written examination;
(vi) The last date of submission of application for these temporary employees sand extended up to 10 May 2019;
(vii) Separate application shall be submitted for each of the posts, taking into account the eligibility criteria;
(viii) The applicants should clearly indicate the service rendered on temporary basis in the application;
(ix) The temporary employees are entitled to one mark for one year of service with a ceiling limit of 10 marks. In case the temporary employees have served for less than one year, the same will be rounded to one year of service, entitling them to a bonus mark of one;
(x) The bonus marks at the rate of one mark for one year will be given only for the interview. In short, the question of giving bonus marks consequent to the temporary service would arise only in case the
candidates qualify in the written examination and are called for interview;
(xi) The communal rotation and reservation and special reservation for widows, physically handicapped, destitute woman, ex-serviceman etc. as notified in the notification shall prevail in the order of preference;
(xii) The posts earmarked for direct recruitment shall be filled up only by the said mode. The promotion to the existing employees should be only in accordance with the service rules. The resultant vacancies shall also be notified for direct recruitment;
(xiii) The prescription regarding age limit would not be applicable to the temporary employees, in case they qualify the age criteria indicated above as on the date on which the initial appointment under 10a(1) was made;
(xiv) The relaxation and preference given to the temporary employee would be treated as a one time measure and it would not be extended for the following year. In short, in case any of the temporary employees fail to clear the test, they would not be given a further opportunity in the next selection and they should compete like any other candidate from the open market for future recruitment;
(xv) The Principal Secretary to Government, School Education Department is directed to allot class rooms in Government schools for conducting the written examination, pursuant to the request made by the District Judges across the State.
(xvi) The District Judges and all the other appointing authorities of the Judicial Department across the State are directed to fill up all the vacant posts on or before 16 July 2019, and a report of compliance shall be filed before the Registry on 17 July 2019, for onward transmission to the Hon'ble Supreme Court;
(xvii) The Registrar General is directed to monitor the process of selection to ensure that the entire process is completed
within the outer time limit prescribed by the Hon'ble Supreme Court.
13. The Writ Petitions are disposed of with the above directions. No costs. Consequently, connected miscellaneous petitions are closed.
