The prayer sought for herein is to order payment out the sum of Rs.34,77,300/- (Rupees Thirty Four Lakhs Seventy Seven Thousand and Three Hundred Only) being the first applicant's / first plaintiff's 1/6th share in the Sale Proceeds of the Suit 'A' Schedule Property by issuing a cheque to and in favour of the first applicant / first plaintiff.

2. Heard the learned counsel appearing for the applicants as well as the learned counsel appearing for the respondents including the third party purchaser.

3. The learned counsel appearing for the respondents / third party purchaser submitted that they did not have any objection in allowing these applications.

4. Since the first applicant / first plaintiff is entitled for the 1/6th of the sale proceeds of the 'A' Schedule Property which comes to the said amount of Rs.34,77,300/- (Rupees Thirty Four Lakhs Seventy Seven Thousand and Three Hundred Only), he seeks indulgence of this Court to order payment out of the said amount. http://www.judis.nic.in

5. Considering the said factual matrix of the case and since there has been no objection for making the said payment out as has been submitted by the respondents herein, the prayer sought for payment out is allowed.

6. Registry is directed to issue payment out in favour of the first applicant / first plaintiff.

Accordingly, these applications are allowed.
