ORDER

Challenge has been made against the concurrent findings of the Rent Court as well as the Appellate Authority ordering eviction.

2. When the Civil Revision Petition is taken up today, the learned counsel appearing for the petitioner filed an undertaking affidavit filed by the revision petitioner stating that he will vacate the premises on or before 30.09.2025. He had also stated in the affidavit that he is willing to receive the amount of Rs.5,00,000/- which is the advance amount, at the time of handing over the vacant possession of the premises.

3. The learned counsel for the respondent submitted that on the date of handing over of possession by the petitioner, the respondent will repay the lease amount of Rs.5,00,000/- to the petitioner.

4. The undertaking affidavit filed by the revision petitioner is taken on record.

5. Accordingly, the revision petitioner shall vacate the premises on or before 30.09.2025. It is made clear that in the event of any violation of the undertaking given before this Court, the revision petitioner will be proceeded 2/4

for contempt. On the petitioner vacating and handing over the premises to the respondent, the respondent shall repay the lease amount of R.5,00,000/-(Rupees Five Lakhs) to the petitioner.
