ORDER

The petitioner, who was arrested and remanded to judicial custody on 11.12.2025, for the offences punishable under Sections 331(3) and 305(a) of BNS Act, 2023, in Crime No.218 of 2025, registered on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner herein involved in stealing of 1.5 sovereigns of gold and 150 grams of silver materials from the house of the defacto complainant and hence, a case has been registered by the respondent police.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case and submitted that though the petitioner is said to have 15 previous cases, in all the cases, he was acquitted; he was in judicial custody from 11.12.2025 and is in custody and the petitioner is ready to abide by any conditions that may be imposed by this Court. Hence, prays to grant bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner, reiterated the prosecution case and submitted that the petitioner herein involved in stealing of gold and silver jewels from the house of the defacto complainant and further, he is also having 18 previous cases and that the property was recovered and that the further investigation of this case is pending. 5.

I have also gone through FIR and other connected records in 2/4

this case. Considering the facts and circumstances of the case and though it is stated that he was arrested on 11.12.2025, he is having 18 previous cases and hence, if bail is granted to the petitioner herein, he will indulge in similar offences and therefore, I am not inclined to grant bail to the petitioner herein. 6.
