C.M.A.No.1318 of 2019 and C.M.P.No.3663 of 2019 V.BHAVANI SUBBAROYAN, J.

This Civil Miscellaneous Appeal has been filed against the fair and decreetal order in IA. No.290 of 2018 in A.S.No.78 of 2018 dated 29.11.2018, on the file of the I Additional District Court, Coimbatore.

2. This Court, by an order dated 20.08.2019, disposed of the appeal with a direction to the learned I Additional District Judge, Coimbatore to dispose of the suit in A.S.No.78 of 2018 within period of sixty (60) days from the date of receipt of a copy of the order. The learned I Additional District Judge, Coimbatore could not complete the proceeding as directed by this Court within period prescribed.

3. Today, when the matter taken up for hearing, Mr.R.Siva kumar, learned counsel for the first and second respondent would submit that the order in C.M.A.No.1318 of 2019, dated 20.08.2019 was made ready on 19.09.2019. The learned counsel would further submit that the application for appointing the legal representative is also pending before the same Court.

4. In view of the above submission, this Court hereby directs the learned I Additional District Judge, Coimbatore, to dispose of the suit in A.S.No.78 of 2018 on or before 20.12.2019 and further direct the lower Court to complete the process of the application of the legal representative within a period of two weeks from 20.11.2012. 23.10.2019 rli http://www.judis.nic.in
