This petition has been filed to modify the condition in para No.3 of the order in Crl.M.P.No.17483 of 2022 dated 22.11.2022.

2. The learned counsel for the petitioner would submit that the brother-in-law of the petitioner is ready and willing to deposit original title deed worth about Rs.50 lakhs, which stands in his name, on behalf of the petitioner and to that effect, the petitioner is also ready to produce the certificate of the revenue authorities. Despite the order being granted on 22.11.2022, the petitioner was unable to arrange any other property stands in the name of the petitoner or his relative or his friends. Thereby, he seeks modification of the above condition.

3.Considering the said submission, the condition imposed as against the petitioner is modified and the petitioner is directed to deposit the original title deeds of immovable property worth about Rs.50 lakhs, stands in the name of one Balaji, who is the brother-in-law of the petitioner along with an affidavit of undertaking that he will not encumber the said property till the completion of the trial proceedings.

Accordingly, this Criminal Miscellaneous Petition is ordered.

4. Time granted by this Court in the Order passed in Crl.O.P.No.24652 of 2022 dated 12.10.2022 is extended by a period of two weeks from the date of receipt of a copy of this order for the purpose of complying the order.
