ORDER

The Writ Petition has been filed challenging the summon issued by the second respondent calling upon the petitioner to appear for enquiry on the complaint lodged by the respondents 3 & 4 herein.

2. The learned counsel for the petitioner would submit that there are factual irregularities and after execution of sale deed by the third respondent in favour of the petitioner, they themselves are now challenging the sale deed as if fraudulently executed in favour of the petitioner.

3. However, now the appeal is pending on the file of the second respondent and the order challenged in this writ petition is only a summon issued to the petitioner to conduct enquiry. Therefore, the second respondent is directed to issue fresh summon to the petitioner and the parties concerned within a period of two weeks from the date of receipt of copy of this order. The petitioner is directed to appear before the second respondent on the summon issued by the second respondent and submit his submissions with documentary evidence, and the second respondent is directed to conduct enquiry after giving them opportunity of hearing and consider the documents produced by the parties concerned and pass orders on merits and in accordance with law within a period of twelve weeks thereafter.

4. With the above directions, this writ petition is disposed of. No order as to costs.
