ORDER

The petitioner herein apprehending arrest at the hands of the respondent police for the offences punishable under Sections 316(2) & 306 of BNS in Crime No.26 of 2026, seeks anticipatory bail.

2. The allegation against the petitioner is that he is ranked as A3 in this case. The petitioner, along with five other accused persons, used to supply eggs and collect money from the traders. Instead of depositing the money into the account of the complainant's firm, he collected the money in his own account and thereby cheated the complainant to the tune of Rs.9.69 lakhs. It is further revealed that all the accused persons together cheated a total sum of more than Rs.35 lakhs. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner has not misappropriated any amount. According to him, the petitioner is only a delivery person and he has not collected any money from the traders. He further submitted that the petitioner is ready to cooperate with the investigation. Hence, he prays to grant anticipatory bail to the petitioner.

4. Per contra, the learned Government Advocate (Crl.side) submitted that the total amount involved in this case is Rs.35 lakhs. He further submitted that A1 and A2 have already been arrested. However, no amount has been recovered so far. The

investigation is still pending. Hence, he opposed to grant anticipatory bail to the petitioner.

Considering the nature of the allegations and the materials available on record, particularly the bank statement of the petitioner and the other statements produced, this Court is of the view that the investigation is still in progress and the amount involved in the case is substantial. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
