Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the 4th respondent to issue separate patta in the petitioner's favour in respect of the land situated in Survey No.Old Survey No.601 and New Survey No.755, Old Survey No.602 and New Survey No.756 situated at New Ward No.56, K-Block, Town Survey Nos.46 to 128, Royapuram Extension, Tiruppur North Taluk measuring to an extent of 7.90 1/2 acre based on the petitioner's application dated 31.12.2015.

Mr.I.Sathish, learned Additional Government Pleader takes notice for the respondents . By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.

2. Heard both sides.

3. The petitioner seeks for a mandamus directing the fourth respondent to issue separate patta in her favour in respect of the land situated in Survey No.Old Survey No.601 and New Survey No.755, Old Survey No.602 and New Survey No.756 situated at New Ward No.56, K-Block, Town Survey Nos.46 to 128, Royapuram Extension, Tiruppur North Taluk measuring to an extent of 7.90 1/2 acre, based on her application dated 31.12.2015.

4. The grievance of the petitioner before this Court is that the said application has not been considered by the fourth respondent so far.

5. This Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner, as it is for the fourth respondent to consider and decide the same on merits and in accordance with law. Accordingly, this writ petition is disposed of, only by directing the fourth respondent to consider the application dated 31.12.2015 and pass orders on the same on merits and in accordance with law, after hearing the petitioner and other interested parties, if any. Such exercise shall be done by the fourth respondent within a period of four weeks from the date of receipt of a copy of this order.
