The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 275, 123 of BNS read with section 24(1) of Cigarette and other Tobacco Products Act, 2003 in Crime No.345 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against that the petitioner is that the petitioner along with other accused involved in transportation of 375 kgs of banned tobacco products. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that the petitioner has 4 previous cases, however he opposed for grant of anticipatory bail to the petitioner. 2/4

5. Considering the fact that huge quantity of contraband involved in this case and the petitioner is having four previous cases and if the petitioner is granted anticipatory bail, he will indulge in similar offence, hence, this Court is not inclined to grant anticipatory bail to the petitioner.
