Respondents Contempt Petition filed under Section 11 of the Contempt of Courts Act, to initiate appropriate contempt proceedings against the respondents herein for noncompliance of the order dated 13.10.2023 passed by this Court in Crl.OP.No.22473 of 2023 and punish them for their failure to adhere to the directions issued by this Court.

ORDER

This Contempt Petition was filed on the ground that the direction issued by this Court in Crl.OP.No.22473 of 2023, dated 13.10.2023, was not complied with.

2.When the matter was taken up for hearing, the learned Government Advocate (Crl.Side) submitted that a referred charge sheet has been filed by the Deputy Superintendent of Police before the Judicial Magistrate Court, Sankarapuram in RCS No.52/2024. The learned Government Advocate (Crl.Side) further submitted that the RCS notice has also been sent to the petitioner by registered post on 19.3.2024.

3.The learned counsel for the petitioner submitted that a slipshod investigation has been conducted in this case and till date, no RCS notice has been received by the petitioner.

4.In the considered view of this Court, the submission made by the learned Government Advocate (Crl.Side) can be recorded and liberty is granted to the petitioner to work out her remedy by filing a protest petition to raise all grounds before the Judicial Magistrate, Sankarapuram. The learned Judicial Magistrate, Sankarapuram, shall hear the parties and pass final orders in the protest petition within a period of eight weeks from the date of filing of the protest petition by the petitioner.
