Prayer :- Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the second respondent herein to release the sale deed executed by the District Munsiff Thiruvottiyur in favour of the petitioner, registered as Document No:5769 of 2019 on 10.09.2019 before the Office of the second respondent. ORDER

This Writ Petition has been filed for the issuance of Writ of Mandamus, directing the second respondent herein to release the sale deed executed by the District Munsiff Thiruvottiyur in favour of the petitioner, registered as Document No:5769 of 2019 on 10.09.2019 before the Office of the second respondent. 2.Heard Mr.K.S.Kumar, learned counsel appearing for the petitioner and Mr.Yogesh Kannadasan, learned Special Government Pleader appearing for the respondents.

3.The learned District Munsif, Thiruvottiyur, executed a sale deed in favour of the petitioner dated 30.08.2019 in pursuant to the decree. It was registered before the second respondent on 10.09.2019, registered vide Document No.5769 of https://hcservices.ecourts.gov.in/hcservices/

2019. After the registration of the sale deed, it was not released to the petitioner. Further, the petitioner was informed that only after field inspection, the sale deed will be released.Though, the petitioner approached the second respondent on several occasions, even till today, the said document has not been released to the petitioner.

4.Considering the above, the second respondent is directed to release the sale deed, dated 10.09.2019, registered vide Document No.5769 of 2019 forthwith if otherwise in order and if not, refer the proceedings initiated under Section 47A or Section 33A of the Registration Act, 1908.

5.With the above directions, this writ petition is disposed of. There shall be no order as to costs.
