ORDER

This writ petition has been filed for direction to the respondents to revise the petitioner's pay scale for the post of Clerk in the third respondent Society with effect from 14.07.2023 and to disburse the arrears of salary.

The petitioner was appointed as Night Watchman in the third respondent Society on 15.12.1995. Thereafter, he was promoted to the post of Office Assistant. The petitioner is qualified with Diploma in Cooperation and he had submitted representation for his promotion to the post of Clerk as per bye-law. The qualification for the post of Clerk is SSLC passed and Diploma in Cooperation. The said representation was forwarded to the respondents. The third respondent Society is a Class 'A' 2/4

Society and there are 7 cadre strength employees i.e. Secretary, Assistant Secretary, Senior Clerk, 2 Clerks, Fertilizer Salesman / Attender and Office Assistant. Considering the said request, the petitioner was promoted to the post of Clerk from 14.07.2023 by the resolution dated 12.07.2023 in the third respondent Society. However, his salary has not been revised so far. Therefore, the petitioner submitted representation on 29.01.2024.

Considering the facts and circumstances of the case, the respondents are directed to consider the representation submitted by the petitioner and pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of copy of this order. 4.

With the above direction, this writ petition is disposed of. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
