Respondents Prayer: Writ petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to consider the petitioner's representation dated 09.05.2018 and 31.12.2018 and to promote the petitioner to the post of Assistant Executive Engineer (Electrical) with effect from 27.02.2018 ie., the date on which the petitioner's juniors were promoted to the said post along with monetary benefits.

O R D E R

The grievances of the writ petitioner is that, based on the order of conviction by the criminal Court of law, he was removed from service. However, the criminal appeal filed by the writ petitioner was allowed and he was acquitted from the criminal charges. Accordingly, the writ petitioner was reinstated in to services. However, the promotions denied are yet to be considered based on the orders of the Court. In other words, the respondents have not considered the case of the writ petitioner https://hcservices.ecourts.gov.in/hcservices/

for grant of promotion on par with his juniors. In this regard, the writ petitioner submitted a representation on 31.12.2018 and the said representation is yet to be considered.

2. Thus, without going into the merits of the matter, the respondent is directed to consider the representation submitted by the writ petitioner on 31.12.2018 and pass orders on merits and in accordance with law within a period of 12 weeks from the date of receipt of a copy of this order.

3. Accordingly, the writ petition stands disposed of. There shall be no order as to costs.
