PRAYER: This criminal miscellaneous petition has been filed under Section 482 of Cr.P.C./528 of the BNSS Act, to modify the condition imposed as the petitioner is directed to deposit a sum of Rs.30,00,000/- to the credit of Crime No.20 of 2024 in Crl.O.P.No.26280 of 2024 order dated 07.11.2024.

ORDER

The petitioner seeks modification on the condition directing him to deposit Rs.30,00,000/- to the credit of Crime No.20 of 2024 in Crl.O.P.No.26280 of 2024 dated 07.11.2024.

2. The learned counsel for the petitioner submitted that the condition imposed on the petitioner in Crl.O.P.No.26280 of 2024 is an onus and ought not to have been imposed.

3. Admittedly, the petitioner had challenged the said direction to deposit before the Hon'ble Supreme Court and the Hon'ble Supreme Court had dismissed the said petition, which has not been pressed. Page No.2 of 4

4. In view of the order of the Hon'ble Supreme Court in SLP (Crl.) No.199 of 2025, dated 10.01.2025, the petitioner seeking modification of the order dated 07.11.2024 in Crl.O.P.No.26280 of 2024 cannot be sustained.
