ORDER

This writ petition has been filed for the issue of writ of Mandamus directing the 1 st respondent to take action on the representation made by the petitioner on 18.11.2024 wherein the petitioner was seeking for the cancellation of the patta that was issued in the name of the respondents 5 and 6 during the

UDR Scheme.

Heard Mr.R.Narendran, learned counsel for the petitioner and Mr.M.R.Gokul Krishnan, learned Additional Government Pleader for respondents 1 and 2.

In the considered view of this Court, the grievance expressed by the petitioner cannot be dealt with by the 1 st respondent, since the mistake had taken place during the UDR scheme. It is the 2 nd respondent, who is the competent authority to deal with the grievance expressed by the petitioner. Apart from the change in the revenue records that was made in favour of the respondents 5 and 6, the further grievance of the petitioner is that some of her property has also been classified as cemetery and poramboke land. In view of the same, there shall be a direction to the petitioner to submit a fresh representation before the nd respondent along with all the relevant documents.

On receipt of the same, the 2 nd respondent shall deal with the representation after affording an opportunity to the respondents 5 and 6, on its own merits and in accordance with law and final orders shall be passed within a period of twelve weeks from the date of receipt of the representation from the petitioner. The DRO shall consider all the grievance that has been expressed by the petitioner and if ultimately it requires reclassification, the matter shall be referred to the District Collector.

This writ petition is disposed of with the above directions. No costs.
