The present Miscellaneous petition has been filed seeking to condone the delay of 289 days in filing the above appeal as against the order passed in STC.No.879 of 2021 on the file of the Judicial Magistrate, Additional Mahila Court, Namakkal vide order dated 02.02.2023.

2. Mr.K.Kalimuthu, learned counsel takes notice on behalf of the respondent and he has no objection for this petition being allowed.

3. Having satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, this petition stands allowed.

4. Registry is directed to number the Criminal Appeal, if the papers are otherwise in order and post the main case for admission.
