This application has been filed seeking a direction to the respondent/A.G. & O.T. to give on lease the property, viz., Door No.246, Ramakrishna Mutt Road (R.K. Mutt Road), Mylapore, Chennai 600 004 for a period of at least 33 years on a monthly rent of Rs.1,20,000/-, subject to a reasonable revision of rent once in three years. When this matter was taken up for hearing, it was submitted by the learned A.G. & O.T. that the property in question has already been leased out to a third party. In view of the above, the aforesaid direction sought in this application cannot be granted. Superadded, be it noted, this Court has already held that the A.G. & O.T. cannot enter into an agreement for lease for a period of more than 3 years at any point of time. However, such a situation does not arise in this case, since, as stated above, the property in question has already been leased out to a third party.
