These intra-Court appeals emanate from the common order dated 05.11.2014 rendered in W.P. Nos.1607 of 2014 etc. batch, by which the said batch of writ petitions was dismissed. 3.1 Shorn of the unnecessary details, the facts in brief, leading to the filing of the instant intra-Court appeals are that all the appellants are owners of agricultural lands of various extents situate in Kannankottai and Thervaikandigai Villages, Gummidipoondi Taluk, Tiruvallur District. The Government of Tamil Nadu issued notifications on 29.05.2013, 31.05.2013, 18.06.2013, 15.07.2013, 18.07.2013, 25.07.2013 and 26.07.2013 under Section 4(1) of the Land Acquisition Act, 1894, (for short "the 1894 Act"), expressing its intention to acquire a large chunk of lands, including the lands under the ownership of the appellants in the aforestated villages for

a public purpose for the formation of Kannan Kottai Thervoy Kandigai Reservoir Scheme land acquisition work, invoking urgency provision, as contained in Section 17 of the 1894 Act, dispensing with the enquiry under Section 5-A, ibid. The said notifications were also published in the Gazette. On the heels of it, Section 6 declarations were made in July/August 2013.

Feeling aggrieved, all the appellants, pooling together, submitted a representation dated 08.08.2013 to the respondents followed by another representation dated 24.09.2013. As a sequel, the final award under Section 11 of the 1894 Act was passed after the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (for short "the 2013 Act"), came into force on 01.01.2014.

Being dis-satisfied, the appellants filed the instant writ petitions challenging the notifications issued under Section 4(1) of the 1894 Act and the declarations issued under Section 6, ibid, contending primarily that the invocation of urgency clause, as contemplated under Section 17 of the 1894 Act, was unnecessary and unwarranted to disable them from placing their objections and as such, the valuable rights vested in them under Section 5-A of the 1894 Act, were unjustly taken away. The other ground taken by the appellants was that the notifications were not properly published. 3.2 The learned Single Judge, after considering all the writ petitions at length, dismissed the writ petitions by the impugned common order.

3.3 Challenging the correctness of the aforesaid common order rendered by the learned Single Judge, the appellants are before us by way of these intra-Court appeals.

Mr. N.R. Chandran, learned Senior Counsel, with Mr.B.S.Jothiraman, learned advocate appearing for the appellants, on instructions, would submit that the appellants are not pressing the ground of invocation of urgency clause, which was the appellants' main plank in the writ petitions and also the appeals, on merit, provided they are paid compensation as per the provisions of the 2013 Act.

Concededly, Mr. A.L. Somayaji, learned Advocate General, submits that the compensation in lieu of acquisition of the lands in question shall be re-determined as per the provisions of the 2013 Act and payment shall be made thereon accordingly. He further submits that the appellants shall not be dis-possessed from the lands in question, till the entire compensation is paid to them, as prescribed under the 2013 Act.

In view of the foregoing, it is ordered accordingly. The appellants shall continue in peaceful possession of the lands in question till the entire compensation, after re-determination, is paid to them.

The intra-Court appeals stand disposed of in the above terms. Costs made easy. Connected Miscellaneous Petitions are closed.
