ORDER
Tracing title from sale deed dated 11.10.1924 and partition deed dated 29.09.1970 bearing Document No.1305/1970, the petitioner presented the sale deed for registration. Such request for 1/4
registration was declined under impugned refusal check slip dated 29.12.2025.

Adverting to sale deed dated 11.10.1924 and partition deed dated 29.09.1970, learned counsel for the petitioner contends that the 'J' Schedule property under partition deed dated 29.09.1970 was allotted to the share of the petitioner. He submits that the vendor under sale deed dated 11.09.1924, unlawfully executed partition deed dated 07.05.1952.
3. Mr.Stalin Abimanyu, learned Additional Government Pleader, accepts notice for the sole respondent. He submits that notices would be issued to all parties interested, including parties to partition deeds dated 07.05.1952 and 29.09.1970 and that the sale deed presented by the petitioner would be registered or a speaking order of refusal would be issued.

On perusal of the impugned refusal check slip, it is noticeable that protest petition No.63 of 2024 dated 26.06.2024, partition deed bearing Document No.490/1952 and partition deed bearing Document No.1305/1970 are cited therein as reasons for refusal. In these circumstances, it is just and necessary that notice be issued to the executants of these documents before a decision is taken.

5. For reasons aforesaid, the petitioner is permitted to represent the sale deed for registration within two weeks from the date of receipt of a copy of this order. Within thirty days therefrom, after issuing notice to all parties interested in the relevant property, the registering officer shall either register the document or issue a speaking order of refusal under Section 71 of the Registration Act, 1908.
6. This writ petition is disposed of on the above terms. There shall be no order as to costs.
