O R D E R

The petitioner, who was arrested and remanded to Judicial custody from on 27.08.2024 for the offences punishable under Sections 147, 148, 302 r/w 149 of IPC in Crime No.1586 of 2015, seeks bail.

2. The allegation against the petitioner is that he was earlier arrested in connection with Crime No.1586 of 2015 and was subsequently released on bail. Thereafter, he was directed to appear before the trial Court and cooperate with the trial proceedings. However, the petitioner failed to appear the trial Court and hence, a Non-Bailable Warrant (NBW) came to be issued against him. The said NBW was executed on 27.08.2024 and thereafter the petitioner has come forward with the present Criminal Original Petition.

3. The learned counsel for the petitioner submitted that the petitioner has been appearing before the Court in accordance with law for nearly one year and he is ready to cooperate with the trial proceedings. Hence, he opposed to grant bail to the petitioner.

4. Per contra, the learned Government Advocate (Crl.side) submitted that the petitioner had absconded nearly five years and in this case totally fifteen accused persons are involved and all the accused have absconding for a considerable period. It is further submitted that the case has already been posted for examination of witnesses. Hence, he opposed to grant bail to the petitioner.

5. Considering the submissions made on either side and taking note of the fact that the petitioner had absconded for nearly five years and that the trial has already been fixed for examination of witnesses, this Court is not inclined to grant bail to the petitioner.
